What type of license does a merchant need to deliver alcohol?

New York

Merchants can deliver beer and/or cider directly to a customer from a licensed NYS brewery or cidery, as long as that brewery or cidery has an active On Premise (OP) license in addition to their manufacturing license. If they do not have an OP license, they cannot deliver their product directly to a customer, only to licensed retail locations.

California

Merchants in California must hold a valid license from the Department of Alcoholic Beverage Control (ABC) that authorizes the sale and delivery of the type of alcohol being offered.

  • Type 20: Off-sale beer and wine

  • Type 21: Off-sale general (beer, wine, and spirits)

Deliveries must comply with all ABC requirements, including:

  • Manufacturer-sealed containers only

  • Recipient must be 21+, ID must be verified at delivery

  • Merchant must be the Merchant On Record for the sale (which Trellus Marketplace is in compliance of)

The merchant is responsible for all regulatory compliance, even when using Trellus or any third-party service.

Oregon

Merchants must hold a valid license issued by the Oregon Liquor and Cannabis Commission (OLCC) that permits off-premises sales and, where applicable, delivery of alcohol.

Eligible license types may include:

  • Off-Premises Sales License (beer, wine, and cider)

  • Brewery, Winery, or Distillery licenses with privileges allowing direct-to-consumer sales

All deliveries must comply with OLCC requirements, including:

  • Alcohol must be in factory-sealed containers

  • Delivery must be made by the licensee or in accordance with OLCC rules governing third-party delivery services

  • The recipient must be 21 years of age or older

  • A valid government-issued ID must be verified at the time of delivery

  • Delivery may not be completed if the recipient is visibly intoxicated

Washington

Merchants must hold a valid license issued by the Washington State Liquor and Cannabis Board (WSLCB) that permits off-premises sales and, where allowed, delivery of alcohol.

Eligible license types may include:

  • Beer and/or Wine Retailer License

  • Spirits Retail License

  • Brewery, Winery, or Distillery licenses with privileges allowing direct-to-consumer sales

All deliveries must comply with WSLCB requirements, including:

  • Alcohol must be in sealed, unopened containers

  • Delivery must be made by the licensee or in accordance with WSLCB rules governing delivery and third-party services

  • The recipient must be 21 years of age or older

  • A valid government-issued ID must be verified at the time of delivery

  • Delivery may not be completed if the recipient is visibly intoxicated

Important Notes (All States)

  • The merchant is the Merchant On Record for all alcohol sales

  • The merchant is responsible for all regulatory compliance, even when using Trellus or any third-party delivery service

  • Deliveries must comply with all applicable state and local laws, which may impose additional restrictions
